Privacy Policy
This Privacy Policy (the “Policy“) applies to your use of the MAPIT web and telematics cell phone application (the “Application“), the functionality of which is made available to you through a subscription (the “Subscription“), as well as the installation of a telematics device that connects to your motorcycle (the “Device“) (collectively, the “MAPIT” or the “MAPIT Package“).
MAPIT is provided by Mapit IoT, S.L. (“Mapit IoT”, “we“, “us“, “our”, and/or “our“), with registered office at calle Casp 172, 4B, 08013 Barcelona and with Tax Identification Number B-66716291 (referred to as “Mapit IoT“).
This Policy explains how Mapit IoT collects, uses, discloses and otherwise treats your personal information in the use of MAPIT. For these purposes, Mapit IoT will be responsible for the processing of personal data associated with the MAPIT Package.
MAPIT IoT may anonymize your personal information in order to use such anonymous data to improve MAPIT.
1. WHAT TYPE OF INFORMATION DOES MAPIT IoT COLLECT AND WHY?
1.1 – When a Device is connected to your motorcycle, MAPIT IoT may collect the following categories of information:
1.1.1 – Your VIN, or “VIN” [por sus siglas en inglés], which identifies your motorcycle (and which is associated with other information about you), its make, model and year of manufacture and purchase.
1.1.2 – Mileage, tire pressure, oil levels, battery condition, date of last service, warnings, incidents and other electronically recorded aspects related to the use and operation of your motorcycle.
1.1.3 – Your bank details and other financial information that may be required when you activate or renew your Subscription.
1.1.4 – Data of the mobile device to which the Subscription is linked through the Application.
1.1.5 – GPS data to determine your location, the location of your motorcycle and/or your mobile device, in relation to the location of your motorcycle, including the relevant locality and country in which each item is located (provided that, where required by law, you have given your prior consent, or there is another lawful reason to process this personal data).
1.1.6 – The speed of travel on your motorcycle, including average speed, parking duration, incidents of hard braking, incidents of acceleration and incidents of speeding above 130 km/h (80 mph); and
1.1.7 – An analysis of the route taken by your motorcycle, including average speed, distance traveled, parking time, events (such as exceeding self-established speed limits).
1.1.8 – In addition to the above, when using MAPIT, MAPIT IoT may also collect the following information in addition to (if applicable), and in connection with, the information listed above:
(i) – Your name and contact details; for example, your address, zip code, country, telephone numbers and/or e-mail address; and
(ii) – Your user PIN (which may contain a reference or information that is of a personal nature).
1.2 – The above information (either on its own or in combination with other information we hold about you) may allow us to identify you personally. This type of personal information is known as “personal data”. Where MAPIT IoT collects such personal data, we will treat that information for the purposes described in this Policy.
1.3 – When you contact us in connection with MAPIT, we may also collect the following personal data:
1.3.1 – Your name and contact details; for example, your address, postal code, country, telephone numbers and/or e-mail address.
1.3.2 – The reason for your contact.
1.3.3 – Information on services that interest you; and/or
1.3.4 – Information required for legal compliance.
1.4 – This information will be collected primarily from you, but we may also collect it, where lawful, from, and combined with, information we may already have about you from public sources, third party service providers, the government, tax and/or law enforcement agencies, and other third parties.
2. HOW DOES MAPIT IoT USE YOUR PERSONAL DATA?
2.1 – Mapit IoT may use the information described in paragraph 1 for the following purposes:
2.1.1 – Answer and/or deal with a request or inquiry from you.
2.1.2 – Improve the functionality and quality of MAPIT.
2.1.3 – Manage MAPIT when you have an active Subscription, which may include (among other things):
(i) – Allow you to locate nearby dealers or workshops and contact them through the Application.
(ii) – Customize your Application experience and gather in one place the key data of your motorcycle, such as model, year of manufacture, engine and VIN, etc.
(iii) – Book an appointment for motorcycle service at the dealer or shop of your choice.
(iv) – Notify you of the date of your next review.
(v) – Locate your motorcycle thanks to GPS.
(vi) – Share the location of your motorcycle.
(vii) – Access data relating to your trips and/or your driving style, such as data on average vehicle speed, parking time, mileage, and GPS.
(viii) – Delimit the zone in which you allow your motorcycle to be ridden and receive an alert if the motorcycle leaves this zone.
2.1.4 – To comply with legal obligations, standards and other good governance obligations; and
2.1.5 – Any other purpose related to the management of your legal relationship with MAPIT IoT.
2.2 – Where we are required by applicable law to obtain your prior consent in order to process your personal data for the purposes described above, we will do so. The above list may be updated periodically based on Mapit IoT’s business needs and legal requirements. In the event that this Policy is updated, we will inform you of such update as required by applicable law.
2.3 – Please note that as MAPIT is improved and updated, we may need to treat your personal data differently from the above. Whenever this eventuality occurs, we will update this Policy.
2.4 – Subject to applicable law, we may also process your personal data for other legitimate business purposes, such as management analysis, auditing, forecasting, business planning and transactions, to ensure compliance with applicable laws, to comply with regulatory requirements and Mapit IoT policies, to deal with legal claims and related investigative and/or administrative activities, and to carry out any applicable record-keeping obligations. In addition, we may process them to establish or exercise our legal rights and to comply with requests from law enforcement and other government agencies or court orders.
2.5 – Please note that as long as a Device is connected to your motorcycle, we may continue to process some of your personal data for the purposes contemplated above, even when your Subscription has expired. Therefore, if you no longer want Mapit IoT to process such Personal Data, you must have your dealer or workshop disconnect or deactivate your device.
2.6 – Mapit IoT may also convert personal data into anonymous data and use it (usually on an aggregated statistical basis) for research and analysis to improve MAPIT. For more information, please refer to the following section Aggregate information.
3. AGGREGATED INFORMATION
3.1 – Aggregate personal information does not personally identify you or any other MAPIT user. It may be used for statistical analysis and administration, such as, for example, trend analysis, performing actuarial work, product customization, risk assessment and associated cost analysis in connection with MAPIT’s operation.
4. Does MAPIT IoT SHARE PERSONAL DATA WITH THIRD PARTIES?
4.1 – Your personal data will be provided for the purposes described above (or for others that may be notified to you in the future and provided that there is a legal reason to do so in accordance with applicable law), not only to Mapit IoT, but also to our external service providers.
4.2 – Mapit IoT will be able to transmit the data to dealers or manufacturers, if requested by the customer.
5. WILL YOUR PERSONAL DATA BE TRANSFERRED ABROAD?
5.1 – Your personal data may be processed or accessed by our service providers (such as Microsoft) who are not located within the European Economic Area (“EEA“) from jurisdictions outside the EEA. Consequently, individuals with a connected Device and/or using MAPIT within Europe should be aware that such recipients may be located in countries or territories outside the EEA and may not have adequate data protection legislation equivalent to that of the EEA. In such cases, measures will be taken to protect their rights and personal data as required by the relevant legislation.
5.2 – It is also possible that Mapit IoT or one of our service providers may transfer the personal data of individuals from other regions outside your own country. By consenting to the connection of a Device and/or activation of a Subscription, and notwithstanding any other requirements under applicable law, such consent shall also act as authorization for the transfer of your personal data as set forth in this Policy.
6. WHAT MEASURES ARE PUT IN PLACE TO PROTECT YOUR PERSONAL DATA?
6.1 – Without prejudice to paragraph 6.2, Mapit IoT will take measures to protect the security of your personal data in accordance with applicable law. Mapit IoT shall take the necessary technical and organizational measures to protect personal data against any unauthorized access, alteration, transmission, public disclosure, erasure or destruction, as well as damage and accidental loss or deletion of personal data.
6.2 – We cannot guarantee the security of any transmission of personal data over the Internet. Communications over the Internet, such as e-mails, are not secure unless they have been encrypted. Thus, while we strive to protect such information, we cannot guarantee or warrant the security of any information transmitted to us. Please do not submit personal data through the Application or any Mapit IoT website unless you accept the inherent security risks and implications of using the Internet.
7. WHAT RIGHTS DO YOU HAVE TO REVIEW, MODIFY AND/OR DELETE YOUR DATA?
7.1 – You will have the right to request information about the processing of your personal data, to access them, as well as to request the rectification of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.
7.2 – In certain circumstances, you may request the limitation of the processing of your data, in which case we will only keep them for the exercise or defense of claims.
7.3 – For reasons related to your particular situation, you may object to the processing of your data. MAPIT IoT will stop processing the data, except for compelling legitimate reasons, for the exercise or defense of possible claims.
7.4 – Under the right to portability, you have the right to obtain the personal data concerning you in a structured, commonly used and machine-readable format and to transmit it to another controller.
7.5 – The RGPD rights may be exercised through:

7.6 – If you feel that your rights have not been properly addressed, you have the right to file a complaint with the Spanish Data Protection Agency.
8. MAINTENANCE OF RECORDS AND THE INFORMATION AVAILABLE TO THEM
8.1 – The data provided will be retained for as long as necessary to carry out the purposes for which MAPIT IoT is authorized and as long as you do not disconnect or deactivate the MAPIT device from your motorcycle at a dealer or workshop, or for as many years as necessary to comply with legal obligations.
9. CHANGES TO THIS PRIVACY POLICY
9.1 – We may modify this Privacy Policy by updating this page to reflect changes in the law and/or our privacy practices. In this case, we will update the date in the Policy header accordingly.
9.2 – Where required by applicable law, we will inform you of any changes. However, we urge you to check this Policy whenever you use the Application.
9.3 – Without prejudice to other requirements that may be required by applicable law, by using the Website, submitting your personal data to us and/or registering an account, you consent to the use and processing of your personal data as described in this Policy (including as amended from time to time).
